Merits review of approval by the NT Minister for Environment, Climate Change and Water Security of Tamboran’s Shenandoah fracking appraisal program.

These proceedings were the first exercise of third-party merits review rights in the Northern Territory Civil and Administrative Tribunal. Such rights are an important check and balance for communities on the administration of NT fracking laws. Acting for the Environment Centre Northern Territory (ECNT).

Discontinued by consent on the basis that ECNT was not permitted to adduce expert evidence in the hearing of this merits review, rendering the proceedings of limited utility in seeking a superior decision.

These proceedings were run by Principal Lawyer Matt Floro of Johnson Legal for ECNT. Adam Searle SC and David Rowe of Counsel appeared for ECNT in the hearing of its applications for a stay and to adduce expert evidence.
